2. Scope of application

The following general terms and conditions apply to all sales contracts for goods with  Andrea Jack Voigt as the seller and her customers are concluded via the web shop at www.cerwenkafashion.com in the version valid at the time of the order. By placing an order, the customer agrees to the following general terms and conditions.

The contract language is German. All other information, customer service and complaint handling are consistently offered in German.

4. Conclusion of a contract

The customer's order is a binding offer to conclude a purchase contract for the goods ordered. An order can only be made if the customer details are fully specified. For every online order via the webshop, the customer receives an electronic order confirmation. The purchase contract is concluded that  Andrea Jack Voigt expressly accepts the order or actually complies with it by sending the ordered goods.

5. Right of withdrawal for consumers in distance selling

If the customer is a consumer within the meaning of the Consumer Protection Act and the contract is concluded using only one or more means of distance communication, such as telephone, letter, fax, email, order form or web form of the web shop, he can withdraw from the contract concluded or the contract declaration made withdraw from the contract without giving reasons by the expiry of the following period. 6. Prices

Unless expressly stated otherwise, all prices include VAT, but do not include postage, shipping costs, customs duties, import sales tax, processing fees, etc. The shipping costs are calculated based on the weight of the delivery. We reserve the right to change prices prior to ordering, as well as input and electronic transmission errors.

7. General terms of delivery

If a sales contract has come about, leads  Andrea Jack Voigt the order without unnecessary delay, at least within thirty days. This delivery period can be exceeded in individual cases if special reasons (e.g. procurement of the goods from abroad) prevent timely execution. 8. Payment, maturity and default

The customer bears all reminder, collection fees and any necessary costs for appropriate legal prosecution by lawyers in the event of default in payment. It is expressly stated that  Andrea Jack Voigt charges a reminder fee of EUR 25 per reminder. For reminders of the intervening lawyer, a flat rate of EUR 100 plus sales tax will be charged.

9. Retention of title

The goods remain the property of Andrea Jack Voigt until they have been paid for in full.

10. Warranty, compensation for damages

If the delivered goods show defects, the general provisions of warranty law apply. 11. Data protection

12. Place of fulfillment, place of jurisdiction

The place of performance is Graz; Only Austrian law. If the legal transaction is not subject to the KSchG, the parties agree on the jurisdiction of the relevant court in Graz. If the customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG) and has his or her place of residence or habitual residence in Austria or if he is employed in Austria, the jurisdiction of the court in whose district the residence, habitual residence or place of the Employment of the customer lies.

13. Copyrights

No part of the products offered may be used without written permission  Andrea Jack Voigt can be imitated or disseminated in any way. The customer acknowledges that the design of the cerwenkafashion.com website, the representations of the products published on the web shop's website and the products themselves are protected by copyright. All rights remain  Reserved for Andrea Jack Voigt.

14. Final provisions

The contract and these general terms and conditions contain all agreements made. Verbal collateral agreements do not exist. Ancillary agreements, subsequent additions to the contract or changes to the contract require written confirmation by Andrea Jack Voigt in order to be effective. Should individual provisions of the contract, including these general terms and conditions, be or become ineffective, this shall not affect the remaining content of concluded contracts or these terms and conditions. The completely or partially ineffective regulation will be replaced by a permissible regulation, the economic success of which comes as close as possible to that of the ineffective one.
